These Terms of Use (“Terms”) are an agreement between you and HOMEX USA LLC, a New Jersey limited liability company doing business as CarLinks (“CarLinks”, “we”, “us” or “our”). They apply to your use of our website at carlinks.io, its free tools and our Sell my car service (together, the “Website”). By using the Website, you agree to these Terms. If you don’t agree, please don’t use the Website.

The CarLinks dealer portal at app.carlinks.io is not covered by these Terms. It is governed by a separate agreement between CarLinks and each dealership. Our Privacy Policy explains how we handle personal information.

1. Who we are

CarLinks provides a private-party vehicle sourcing service and a workspace for dealerships. Our agents find vehicles offered by private sellers, contact sellers, share vehicle details with partner dealerships, pass offers between sellers and dealerships, and arrange inspections or visits. Our sourcing and support team is provided by our affiliate, HOMEX VIRTUAL AGENCY LLC.

CarLinks is not a dealer and does not buy vehicles.

2. Who may use the Website

  • You must be at least 18 years old and able to enter into a binding contract to submit our contact form or Sell my car form.
  • If you use the Website for a dealership or other business, you confirm that you are authorized to accept these Terms for it, and these Terms bind that business as well as you.
  • The Website is intended for people in the United States.

3. The Website and free tools are for information only

The articles, guides and tools on the Website are general information. They are not legal, tax, financial or mechanical advice, and they don’t replace checking a vehicle, its documents and the rules that apply to you. Laws and motor vehicle agency requirements change, so check official sources before you rely on them.

  • VIN barcode generator. It creates a barcode image from the VIN you enter. It doesn’t create, verify or authenticate VINs. Its check-digit test can flag likely typing errors, but many valid VINs from outside North America fail it, and a VIN that passes can still be wrong. Before you rely on a barcode you print, check that it scans correctly and matches the vehicle.
  • VIN barcode scanner. It reads barcodes from your camera or an image. Barcodes can be damaged or misread, so always compare the result with the VIN on the vehicle and its documents.
  • VIN decoder. It shows manufacturer specification data from the public vPIC database of the National Highway Traffic Safety Administration (NHTSA). It does not show a vehicle’s history, title, ownership, liens, theft, accident or odometer records, or its value. NHTSA’s data can be incomplete or wrong, mainly covers vehicles made for the US market, and depends on NHTSA’s service being available.
  • Dealer acquisition calculator. It does arithmetic on the figures you enter. Its result is an estimate based only on those figures. It is not a valuation, appraisal, offer, profit guarantee or financial advice.

How it works. When you submit the Sell my car form, or when one of our agents contacts you about a vehicle you’ve listed, a CarLinks agent may contact you, share the vehicle’s details with dealerships we work with, pass on any interest or offers and, if you and a dealership want to go ahead, arrange an inspection or visit. The dealership inspects the vehicle and decides whether to buy it.

No obligation and no guarantees. You don’t have to accept any offer or sell your vehicle. CarLinks does not promise that we will contact you within any particular time, that any dealership will be interested, or any offer, price, sale, payment or timeline. We may decide not to work on a vehicle for any reason, for example because it is outside the areas we serve.

CarLinks is not the buyer. CarLinks is not a dealer, does not buy vehicles and is not a party to any sale. Partner dealerships are independent businesses. Each dealership decides for itself whether to make an offer and whether to buy, and is responsible for its own offers, inspection, payment, title transfer and paperwork. Any sale is between you and the dealership, on terms the two of you agree.

Offers. Our agent passes information, offers and counteroffers between you and dealerships, and you decide whether to accept a price. Offers come from dealerships, not from CarLinks, and a dealership may change or withdraw an offer, for example after inspecting the vehicle.

Your promises. When you give us information about a vehicle, you confirm that:

  • you own the vehicle or are authorized to sell it, and you will tell us about any loan, lease or lien on it
  • the information and photos you give us are accurate and complete to the best of your knowledge, show the vehicle you are selling, and you will tell us if anything changes
  • you have the right to share the photos you send us
  • you will meet the legal requirements that apply to the sale, such as transferring title, providing any required smog or emissions certificate and filing any required notice of transfer

Contact. By ticking the consent box on our form, you agree that CarLinks may contact you about selling the vehicle by phone call, text message and email at the number and address you provided. Agreeing is not a condition of selling: you can call or email us instead. You can withdraw your consent at any time by telling us. Section 5 explains how to stop text messages.

Your photos and details. You keep ownership of the photos and information you send us. You give CarLinks permission to store, copy, resize and use them, and to share them with partner dealerships, only to provide our service and as our Privacy Policy describes. We won’t post your photos or contact details publicly.

5. Text messages

These terms apply when CarLinks texts you about a vehicle you are selling.

  • What we send: messages from our agents about your vehicle, such as questions about it, updates on dealership interest and arrangements for an inspection or visit.
  • How often: message frequency varies with your conversation.
  • Cost: message and data rates may apply.
  • Stopping texts: reply STOP at any time. After that, we won’t text you again unless you ask us to.
  • Help: reply HELP, call (562) 200-0003 or email [email protected].
  • Delivery: mobile carriers are not liable for delayed or undelivered messages.
  • Privacy: we don’t share mobile phone numbers or text-message opt-in information with third parties or affiliates for their marketing. Our Privacy Policy explains how we handle your information.

6. Acceptable use

When you use the Website, you agree not to:

  • give false or misleading information, give someone else’s information without their permission, or submit a vehicle you are not entitled to sell
  • send spam or test submissions, or use our forms to harass anyone
  • scrape, crawl or harvest content or data from the Website by automated means, other than search engines that follow our robots.txt file
  • use bots or scripts to submit forms or to make large numbers of VIN decoder requests, or try to get around rate limits, bot protection or other security measures
  • interfere with or disrupt the Website, probe or test it for vulnerabilities without our written permission, or try to reach systems or data you are not authorized to access
  • upload viruses or other harmful code
  • copy, resell or offer the free tools as part of another product or service, or frame the Website
  • use the Website to break the law or to infringe anyone’s rights

7. Intellectual property

The Website, including its text, design, graphics, logos, software and tools, is owned by CarLinks or its licensors and protected by intellectual property laws. The CarLinks name and logo are our trademarks. You may view and use the Website for your own personal or internal business purposes, share links to its pages, and use the barcodes and calculations you create with the free tools for any lawful purpose. Otherwise, you may not copy, modify, distribute or create works based on the Website without our written permission.

If you send us ideas or feedback, we may use them without any obligation to you.

The Website links to and relies on services run by other companies, including Calendly for booking a demo, the social-media platforms where we have accounts, and NHTSA’s vPIC database. The Dealer login link opens the CarLinks dealer portal, which is governed by its own agreement. We don’t control other companies’ websites and services and aren’t responsible for them. Their own terms and privacy policies apply when you use them.

9. Disclaimers

The Website, its tools and our Sell my car service are provided “as is” and “as available”. To the fullest extent the law allows, CarLinks disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We don’t promise that the Website will be uninterrupted, error-free or secure, or that information on it or produced by its tools is complete, current or correct. CarLinks is not responsible for the acts, offers, inspections, payments or paperwork of any dealership.

10. Limitation of liability

To the fullest extent the law allows:

  • CarLinks, its affiliates, and their members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the Website, the Sell my car service or your dealings with any dealership, even if we were told such damages were possible.
  • Our total liability for all claims arising out of or relating to these Terms or the Website will not exceed one hundred US dollars ($100).

Nothing in these Terms limits any liability that the law does not allow us to limit.

11. Indemnity

To the extent the law allows, you agree to indemnify and hold harmless CarLinks, its affiliates, and their members, managers, employees and agents from any claims, losses, liabilities, damages, costs and expenses, including reasonable attorneys’ fees, arising out of your breach of these Terms, information or photos you submit, your misuse of the Website, or your violation of any law or of anyone else’s rights.

12. Suspending access

We may suspend or block your access to the Website, remove or decline any submission, or stop working on a vehicle at any time if we believe you have broken these Terms, or to protect the Website, our users or others. Sections 4 (Your promises and Your photos and details), 7, 9, 10, 11, 14 and 15 continue to apply after your use of the Website ends.

13. Changes

We may change or stop offering any part of the Website, including any tool, at any time. We may also update these Terms. When we do, we will post the new version on this page with a new “Last updated” date, and we will post a notice on the Website if the change is material. Changes apply from the date we post them and don’t apply to a dispute that arose before then. If you keep using the Website after a change, you accept the updated Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Website will be decided only by the state or federal courts located in New Jersey, and you and CarLinks consent to those courts’ jurisdiction. This section does not take away any right you have under the consumer protection laws of the state where you live that cannot be waived by agreement.

If you have a concern, please contact us first. Most issues can be resolved quickly without going to court.

15. General

  • These Terms and our Privacy Policy are the entire agreement between you and CarLinks about the Website. If you are a dealership user, your dealership’s agreement with CarLinks governs the dealer portal.
  • If any part of these Terms is found unenforceable, the rest stays in effect.
  • If we don’t enforce a part of these Terms, that doesn’t waive our right to enforce it later.
  • You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, for example as part of a merger or sale of our business.
  • These Terms don’t create a partnership, joint venture, employment or agency relationship between you and CarLinks.
  • Headings are for convenience only.
